這個市場公開交易的標的，是所謂 "unit license"，看起來像是針對一定數量的產品的授權。由於是公開交易，所以授權金是透明的。這個交易市場看起來會增進專利授權的自由度與透明度。看看它會不會成功吧。本週就開始運作囉。

本案值得注意的，是應否就工業標準相關專利頒發禁制令的問題。對此問題，ITC在審酌各方意見後，最後這樣說：

The Commission has determined that the public interest factors enumerated in section 337(d)(1) and (f)(1) do not preclude issuance of the limited exclusion order and cease and desist order. The Commission has determined that Samsung’s FRAND declarations do not preclude that remedy.

在Commission中，有人對此發表不同意見書：

Commissioner Pinkert dissents on public interest grounds from the determination to issue an exclusion order and cease and desist order.

立法院三讀通過「專利法部分條文」修正案 (www.tipo.gov.tw, 2013/5/31)

重點如下：

1. 發明與新型同日申請改採權利接續說 (第32條)
2. 權利接續說的賠償金採擇一方式 (第41條)
3. 恢復三倍的懲罰性賠償 (第97條)
4. 新型專利未檢索不得警告 (第116條)

EFF wants $30,000 to defeat a podcasting patent troll (arstechnica.com, 2013/5/31)

內容重點：有patent troll宣稱其擁有podcasting技術的專利。EFF (Electronic Frontier Foundation) 想公開籌資30000美金去舉發這個專利無效。第一天就募得11,000美金。

不知道這個募資來對抗patent troll的模式，能不能用KickStarter來操作？有興趣的朋友也許可以研究看看喔。


外商授權金擬免稅 企業專利成本將大降 (udn.com, 2013/5/22)

針對新聞稿中，"政府提供免稅後，高通將會將免稅額度直接反映在產品售價上" 這個邏輯，真的沒問題嗎？此外如果真的通過，那國內廠商要記得這樣操作啊。法務、會計、採購跟業務都要懂這個。不然只是讓外商賺到而已。
